Canadian Tribunal Extends Anti-Dumping and Anti-Subsidy Duties on Silicon Metal from China

The Canadian International Trade Tribunal (CITT) has announced the continuation of its existing order concerning the dumping and subsidizing of certain silicon metal imports from the People鈥檚 Republic of China. The decision, issued on April 30, follows an expiry review and ensures that anti-dumping and countervailing duties will remain in place on specific grades of silicon metal originating from China.

The order, initially established on November 19, through inquiry NQ-2013-003 and subsequently continued on August 22, 2019, in expiry review RR-2018-003, pertains to two categories of silicon metal. These include silicon metal containing at least 96% but less than 99.99% silicon by weight, and silicon metal containing between 89% and 96% silicon by weight that contains aluminium greater than 0.20% by weight, regardless of their form or size.

The CITT conducted a thorough expiry review to determine whether the expiration of the existing order would likely lead to injury to the Canadian domestic industry. Based on the evidence and analysis presented, the Tribunal concluded that allowing the order to expire would indeed result in such injury. Consequently, the CITT has decided to continue the order without any amendments.

This decision means that the Canada Border Services Agency (CBSA) will persist in collecting anti-dumping and countervailing duties on the specified silicon metal products imported from China. These duties are intended to offset the unfair trade practices of dumping (selling goods at below their normal value) and subsidizing (providing financial assistance to producers that gives them an unfair advantage) which can harm domestic producers.

The continuation of these duties provides ongoing protection to Canadian manufacturers of silicon metal, allowing them to compete on a more level playing field with imports from China. Silicon metal is a crucial material used in various industries, including the production of aluminium alloys, silicones, and solar panels. Maintaining a healthy domestic industry is vital for Canada's economic security and supply chain resilience in these key sectors.

The Canadian International Trade Tribunal is an independent quasi-judicial body accountable to Parliament through the Minister of Finance. Its mandate includes hearing cases related to dumped and subsidized imports, safeguard complaints, federal government procurement challenges, and appeals of customs and excise tax rulings. Additionally, the Tribunal offers advice to the federal government on a range of economic, trade, and tariff-related matters when requested. The CITT鈥檚 decision to extend the duties on silicon metal from China underscores its role in safeguarding Canadian industries from unfair international trade practices.
